Stay Now Albany Accommodation & Holiday Rentals Terms & Conditions 
TERMS AND CONDITIONS

 

Travel arrangements and published prices including those detailed on the Internet site are provided and coordinated by the Albany Visitors Centre, Trading as: 'The Albany Regional Booking Service'; and: 'Stay Now', either entity is hereafter referred to as 'The Booking Agent'. 
Due care has been taken to verify and check all information including the Internet sites as at time of compilation and transaction of bookings.  However, as 
the relevant accommodation & tour operators supply this information, The Booking Agent accepts no responsibility for any inaccuracy or misdescription contained in publications or on the Internet sites. All information is as so supplied. The person making the booking is referred to hereafter as 'The Client'. The property owner or manager is referred to hereafter as the 'Operator'.

Booking Conditions:
1. The 'Client' must be at least eighteen years of age. The Client must be authorised on behalf of all other members of the party making the booking.
2. The booking is made on the basis the Booking Conditions shall apply to all members of the party. By making the booking, the Client confirms that he or she 
is so authorised and that at other party members agree that the booking is subject to these Booking Conditions.
3. The 'Client' is responsible for making payments prior to arrival and payment is made to the Booking Agent. A payment equal to no less than 30% of the cost 
is required at the time of making the booking and the balance payable with 14 days of arrival.
4. The booking is made on the basis that the Client agrees that no liability can be accepted by the Accommodation Provider also referred to as the Operator 
for expenses, costs, losses, claims or other sums of any description which relate to the occupation of the property.
5. The Client and all members of the party agree the premises cannot be used for any purpose other than the provision of accommodation. The Client and all 
members of the party further agree not to use the property for any commercial, unlawful or anti social purpose.
6. The Client is responsible to the Operator for the actual costs of any breakage or damage in or to the property along with any additional costs that may 
result -which are caused by the Client and/or any members of the party and the Operator can require payment from the Client to cover any such costs. The Client agrees to keep the property clean and tidy and to leave the property in a similar condition as it was found upon arrival. The Client agrees to pay all costs incurred in connection with cleaning or restoration of the condition following occupancy by the Client.
7. The Operator is entitled at his/her sole and absolute discretion to refuse to hand over to the client, or to repossess the property where damage is 
reasonably believed to be caused by the Client or any members of the party, or where quiet possession is disrupted or threatened. Under these circumstances such an event will be treated as a cancellation of the booking by the Client.
8. The Client must not sublet, or allow more people than stated in the original booking to occupy the property without the consent of the Operator or the 
Booking Agent. If this were to occur without consent, an additional payment will be required to compensate the Operator for the loss of revenue and all associated cost incurred resulting from the occupation of the property. The Client or any member of the party cannot take any animal into the property unless this has been arranged in advance and acknowledged at in the booking confirmation.  If the Client does any of these things, the Operator can refuse to hand over the property, or may repossess it.  If the Operator does so, this will be treated as a cancellation of the booking by the Client. In these situations no refund of any monies paid in respect of the booking will be made and neither the Operator nor the Booking Agent have any liability to the Client as a result of the situation arising.
9. The Client agrees to vacate accommodation by 10am on the end date specified on the Itinerary unless otherwise agreed with the Booking Agent.

10. Cancellation of Confirmed bookings (where payment has been made) will attract a $50 (Inc of GST) Administration Cancellation Fee. The Administration Cancellation Fee is in addition to any advertised Cancellation Fee the Operator may impose. Credit Card Fees are non-refundable. Amended bookings will attract a variable booking amendment fee not exceeding 1.9% of the total value of the booking.
11. The Booking Agent reserves the right without recourse to offer alternative accommodation and/or tour of a similar standard in the event of force majeure 
or any other reason which is outside of the control of the Booking Agent or in the event of the Operators Failure to meet obligations arising in respect to any booking transaction.
12. The Booking Agent facilitates bookings of tours and accommodation on the express condition that it is not liable for any injury, damage, loss, accident, 
delays generally, inconvenience or any irregularity which may be caused by errors and omissions, reason of any defect in any vehicle, vessel, or any company or person engaged in conveying of passengers, or in the carrying out of arrangements of the tours and travel or the provision of accommodation.
13. Literature available in the Albany Visitor Centre and information on the WWW website may contain information about activities which by reason of their 
physical exertion or the degree of physical fitness required may be unsuitable or dangerous for certain persons to undertake, or activities may be described which are inherently dangerous. The Booking Agent makes no representations of fact, nature, quality and suitability about any or all of the activities promoted and the Client agrees to accept responsibility for first satisfying himself/herself by independent enquiry or advice as to their suitability of the particular activity.
14. When the Client receives confirmation, the details must be checked carefully. The client is deemed to have validated the booking unless notification of 
any error or omission is communicated in writing immediately and in any event no later than 24 hours of the booking transaction. The Booking Agent accepts no liability for errors or omissions where the Client has failed to immediately notify details of any errors or omissions.
15. When a Client makes a booking for either a tour or accommodation more than 30 days prior to the event or arrival, the Client must reconfirm and validate 
the booking within five business days prior to the event or arrival.
16. Once the Booking Agent issues a written confirmation to the Client, this signifies that the Operator has entered into a binding contract with the Client 
which is subject to these Conditions.
17. The Laws of West Australia shall apply to these conditions.
18. All currency quoted in publications, documents and Internet websites is in Australian Dollars ($AUD).

What Information We Collect
In an effort to keep our service as simple and easy as possible we do not create, use or store profiles of our customers. We only record PII and other information that we reasonably require to do business with you. ’StayNow’ collects PII when you do the following:
• Make a booking
Your full name, address, email address and phone number are taken each time you make a booking with ‘StayNow’.
• Contact
‘StayNow’ collects PII such as your full name, address, email address and/or telephone number whenever you submit a query or suggestion, or request assistance with a booking.
We will only collect personal information from you with your prior knowledge and consent. You can access our website home page and browse our site without disclosing personal information.
When you visit our website, our Internet Service Provider makes a record of your visit and logs information for statistical purposes which includes your server address; Your top level domain name; The date and time of your visit to the site; The pages you accessed and documents downloaded; The type of browser you are using. In short, if you visit our site to browse, read or download information, our system will log these movements. These website logs are not personally identifiable, and we make no attempt to link them with the individuals who browse the site.
 
How We Use Your Information
’StayNow’ uses your PII only for the purpose of responding to and fulfilling your requests for our products and services. Information collected on staynow.com may be used to:
• Purchase ‘StayNow’ products or services.
Information collected when you purchase from ‘StayNow’ is used to charge your credit card and deliver your booking confirmation electronically. We may also contact you about your stay for customer service purposes or to make any changes or cancellations to your booking.
• Respond to your questions or suggestions.
We will use your address, email address and/or telephone number to contact you when you submit a question or suggestion.
 
Who We Share Your Information With
’StayNow’ does not disclose any information about customer bookings to anyone except in the following circumstances:
• Accommodation suppliers.
’StayNow’ provides the guest name, telephone number, address and email address for each booking made to the relevant accommodation supplier. Our accommodation suppliers require this information for the booking and if they need to contact you about the booking. Although ‘StayNow’ offers accommodation from reputable accommodation suppliers, we have not placed specific limitations on these suppliers from using or disclosing your information without your permission. Therefore, we encourage you to review the privacy policies of any suppliers whose accommodation you purchase on ‘StayNow’.
• Legal obligations.
’StayNow’ may be required by law to disclose information provided by you. ‘StayNow’ may also disclose information against someone who poses a threat to ‘StayNow’ interests (such as customer fraud) or whose activities could cause harm to others.
 
How You Control and Access Your Information
’StayNow’ believes that site visitors and customers should have control over the collection and use of their PII. You have control and access to your information as follows:
• Booking information.
If at anytime you would like to alter the PII you provided to ‘StayNow’ in your booking, please contact us.
 

Validity of Rates

Accommodation costs are for room only and do not include transfer or breakfast cost unless otherwise stated. Prices are inclusive of the Australian Goods and Services Tax. Prices over accommodation block out periods may alter from the prices advertised. Contact us for further details. Deposits
Payment is due within 48 hours of receiving written confirmation from ‘StayNow’. Please proceed to our "Secure Payment" form to submit credit card details.
 
Cancellation Policy
Cancellation of Confirmed bookings (where payment has been made) will attract a AUD$50.00 (inc. GST). Administration Cancellation Fee is in addition to any advertised Cancellation Fee the Service Provider may impose. ‘StayNow’ reserves the right to offer alternative accommodation/tour of a similar standard in the case of the accommodation/tour operator over booking their property or for other any reason beyond our control.
 
Tours
These operators reserve the right to alter itineraries at any time as a result of fire, flood, extreme weather conditions or any other circumstance beyond their control.
 
Photographic
The photos on this site are protected by copyright laws and strictly not permitted for use without the prior written authority of the owner. While many belong to ‘StayNow’ or Albany Inbound Pty Ltd, many are the work of private photographers. For further information pertaining to the use of the photos please contact ‘StayNow’.
